Welcome to Community Action's Tenant Support Services resources website. Our Tenant Support Services program focuses on eviction prevention, landlord and tenant mediation, and information regarding tenant rights and obligations in the state of Nebraska. This website was made possible through funds from the Keno Human Services Prevention Fund, and has been developed with Lincoln, NE tenants in mind. Our goal is to provide local tenants with the information and resources necessary to maintain successful relationships with landlords and know their rights and responsibilities. CDC Eviction Moratorium

The Centers for Disease Control and Prevention (CDC) declared an eviction moratorium on people facing eviction due to non-payment of rent.
This moratorium does not stop all evictions. Evictions for reasons other than non-payment of rent may continue.
In order to qualify for this order, the tenant must be able to truthfully declare and give a written declaration to the following:

  • The tenant has used their best efforts to obtain government assistance for rent or housing;
  • The tenant expects to earn less than $99,000 in annual income for 2020, was not required to report income in 2019 to the IRS, or the tenant received an Economic Income Payment (stimulus check)
  • The tenant is unable to pay rent due to a substantial loss in household income or extraordinary out-of-pocket medical expenses
  • The tenant is using best efforts to make a timely full or partial rent payments
  • If evicted, the tenant would likely become homeless, need to move to a homeless shelter, or move into a new residence shared by other people living in close quarters
  • The tenant understands they are still responsible to pay all rent and late fees that become due and fulfill all other terms of the lease; and
  • The tenant understands the eviction moratorium is only through December 31, 2020 and if rent is not paid prior to that date, the tenant may be evicted after December 31, 2020.

Every adult in the household and on the lease must sign the declaration. Tenants should keep a copy of the signed declaration for their own records and deliver the original to the landlord as soon as possible if they are unable to pay rent.

This declaration is signed under penalty of perjury and any false information can result in criminal prosecution.

This eviction moratorium ends December 31, 2020.
